The event that triggers whether or not you need your Candidate's
written permission is the following. Will you be acquiring any of
your information from a third party for "consideration" (usually,
money in payment of invoices from the third party) ? If the answer
is Yes, you need to follow the FCRA guidelines. If the answer is
No, and you will be doing all of the information gathering yourself or
with your own employees, you do not fall under the FCRA guidelines.
However, most employers do not have the time to make the trips to the courthouses,
or write the letters to DMV bureaus, past employers, and schools. Also, most
employers do not own the technology for drug testing. Hence,
they purchase help from third parties that they can trust like The Integrity
Center, Inc.who will get the information accurately, promptly and for
relatively little cost. For that reason, and because they
want to be absolutely uniform in their treatment of job candidates, most
companies opt to enforce a strict policy of FCRA compliance.
